Nagaenthran‘s lawyers to challenge his execution in Singapore High Court tomorrow

NAGAENTHRAN Dharmalingam’s lawyers are seeking a prohibitory order to stop his impending execution in Singapore tomorrow in a final attempt to save him from the gallows.

Nagaenthran’s Malaysian counsel N. Surendran  told The Malaysian Insight that an originating summons was filed in the republic’s High Court on November 2.

“It will be heard by the High Court on November 8 at 2.30pm,” he said.

“We are asking for declarations that the sentence of death is contrary to Articles 9 and  12 of the Singapore Constitution and a prohibitory order to stop the execution,” he added.

Article 9(1) of the Singapore Constitution states that no person shall be deprived of his life or personal liberty save in accordance with law” while Article 12(1) states “all persons are equal before the law and entitled to the equal protection of the law”.

Naegenthran is represented in Singapore by human rights lawyer M. Ravi.

The Court of Appeal in Singapore dismissed Nagaenthran’s appeal against his death sentence in 2019 for carrying 42.72g of heroin into the country.

He was caught in April 2009 while entering Singapore from Malaysia via the Woodlands Checkpoint with a bundle of heroin strapped to his thigh.

The Malaysian Insight reported today that Nagaenthran’s mother, Panchalai Supermaniam, 59, was in Singapore to see her son for the last time.

Family members said Nagaenthran had called home and asked his mother to visit him.

Nagaenthran’s sister, Sharmila, said they had initially kept the news away from their mother but they decided to tell her when Nagaenthran called and asked to see his mother.
